These Terms of Service (“Terms”) govern your use of the Once Upon America mobile application and the onceuponamerica.us website (together, the “Service”), provided by Once Upon America (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms.
1. Eligibility and accounts
The Service is intended for use by adults (age 18 or older) on behalf of the children in their care. You agree to provide accurate information when creating an account and to keep your credentials secure. You are responsible for activity that occurs under your account.
2. Subscriptions, billing, and cancellation
Once Upon America is offered on a subscription basis at $2.99/month or $24.99/year. Subscriptions are billed by Apple (App Store) or Google (Google Play) and automatically renew until canceled.
You can cancel at any time through your App Store or Play Store account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for the unused portion of a period.
Refund requests are governed by the platform you purchased through. App Store: reportaproblem.apple.com. Google Play: support.google.com/googleplay.
3. Free trial
New subscribers may be eligible for a free trial. Cancel before the trial ends to avoid being charged. Trial eligibility is determined by Apple or Google.
4. Content and intellectual property
All stories, illustrations, audio, and other content in the Service are either owned by us, licensed to us, or in the public domain. You may use the content solely for personal, non-commercial listening within the app. You may not copy, redistribute, public-perform, modify, or use the content to train machine learning models without our prior written consent.
The Once Upon America name, logo, and trade dress are our trademarks (or pending trademarks). All other trademarks are the property of their respective owners.
5. Acceptable use
You agree not to:
- Use the Service in any way that violates applicable law.
- Attempt to circumvent paywalls, family-sharing limits, or DRM.
- Reverse-engineer, scrape, or extract content from the Service.
- Resell, sublicense, or commercially exploit the Service.
- Use automated agents to download content in bulk.
6. Children
Once Upon America is made for children but is purchased and managed by adults. You are responsible for supervising your child's use of the Service. See our Children's Privacy page for our COPPA-aligned practices.
7. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
8. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenue, or data, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months preceding the event giving rise to the claim.
9. Termination
We may suspend or terminate your account if you violate these Terms. You may delete your account at any time by emailing support@onceuponamerica.us.
10. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will notify subscribed users by email and post the updated Terms here with a new “Last updated” date.
11. Governing law and dispute resolution
These Terms are governed by the laws of State of California, USA, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of the Service will be resolved by binding arbitration on an individual basis. You waive any right to a jury trial or to participate in a class action, except where prohibited by law.
